Privacy Policy

1. Data Controller. OrionMetricLabs, registered at Calle Volver a Empezar 8 E, Planta Baja B, Madrid, Spain, is the data controller responsible for the processing of personal data collected through this website and its associated services.

2. Data We Collect. We collect only the personal data you voluntarily provide through our contact forms, email communications, or service engagement processes. This includes: your full name, email address, phone number (if provided), project description, and any technical specifications you share. We do not collect IP addresses, browser fingerprints, geolocation data, or any passive tracking information.

3. Purpose of Processing. Your personal data is processed exclusively for: (a) responding to your inquiries and providing requested quotations; (b) executing agreed-upon service contracts; (c) sending project-related communications; (d) maintaining legally required financial records. We do not use personal data for automated decision-making, profiling, or marketing purposes without explicit written consent.

4. Legal Basis (GDPR Article 6). Processing is based on: (a) your consent (Art. 6(1)(a)) when you submit a contact form; (b) performance of a contract (Art. 6(1)(b)) when you engage our services; (c) our legitimate interest (Art. 6(1)(f)) in responding to business inquiries; and (d) legal obligations (Art. 6(1)(c)) for tax and accounting records.

5. Data Retention. Contact form submissions are retained for a maximum of 24 months after the last interaction. Contract-related data is retained for 6 years following project completion, as required by Spanish commercial and tax legislation. Upon expiration of these periods, all personal data is permanently deleted from our systems.

6. Data Sharing. We do not sell, rent, or share your personal data with any third parties except: (a) payment processors (Stripe) strictly for transaction execution; (b) hosting infrastructure providers essential to service delivery; (c) legal authorities when required by binding court order or applicable law. All third-party processors operate under written data processing agreements compliant with GDPR Article 28.

7. International Transfers. Your data is stored within the European Economic Area. Should any transfer outside the EEA become necessary, we will ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission.

8. Your Rights (GDPR Chapter III). You have the right to: access your personal data (Art. 15); rectify inaccurate data (Art. 16); request erasure ("right to be forgotten") (Art. 17); restrict processing (Art. 18); data portability (Art. 20); object to processing (Art. 21); and withdraw consent at any time (Art. 7(3)). 9. Supervisory Authority. You have the right to lodge a complaint with the Agencia Española de Protección de Datos (AEPD) at www.aepd.es if you believe your data protection rights have been infringed.

10. Security Measures. OrionMetricLabs implements appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction, including encryption of data in transit, access controls, and regular security audits.

Cookies Policy

1. What Are Cookies. Cookies are small text files placed on your device by websites you visit. They serve to remember your preferences, maintain session state, and ensure core website functionality.

2. Cookies We Use. OrionMetricLabs employs only strictly necessary cookies. Specifically: (a) a single localStorage entry to remember your cookie consent preference. This does not transmit data to any third party and exists solely on your local device.

3. What We Do NOT Use. We do not deploy: Google Analytics, Facebook Pixel, Hotjar, Mixpanel, advertising trackers, social media widgets, A/B testing scripts, session recording tools, or any third-party analytics or marketing cookies. Our website has zero external tracking dependencies.

4. Consent. Upon your first visit, a cookie consent banner is displayed. You may accept or decline. If you accept, a localStorage flag is set to prevent the banner from reappearing. If you decline, no cookies or local storage entries are created. You may clear your consent at any time by clearing your browser's local storage for this domain.

5. Embedded Content. Our contact page contains a Google Maps iframe for location reference. Google may set its own cookies when this iframe loads. We have enabled "lazy loading" to minimize this behavior. For full details on Google's cookie practices, consult Google's Privacy Policy.

6. Managing Cookies. You can control and delete cookies through your browser settings. Disabling all cookies may impair basic website functionality, though our site is designed to remain fully functional with cookies disabled.

7. Changes to This Policy. Any modifications to this Cookies Policy will be reflected on this page with an updated revision date. Continued use of the website following changes constitutes acceptance of the revised policy.

Refund Policy

1. Scope. This Refund Policy applies to all services provided by OrionMetricLabs, located at Calle Volver a Empezar 8 E, Planta Baja B, Madrid, Spain. It governs refunds for custom API integration work, third-party software connector development, cloud infrastructure deployments, and all other services offered through this website.

2. Project Milestone Refunds. Payments are structured around agreed project milestones. If a project is terminated before a milestone is reached, the client is entitled to a refund of any payments made for milestones not yet delivered. Milestone deliverables that have been completed and accepted by the client are non-refundable.

3. Cancellation Before Work Begins. If a service engagement is cancelled before any work has commenced, a full refund of the initial deposit will be issued within 14 business days, minus any applicable bank transfer fees.

4. Partial Work Refunds. If work has been partially completed upon cancellation, the client will receive a prorated refund based on the percentage of remaining undelivered milestones. The delivered portion is assessed based on documented project progress reports shared with the client at each milestone boundary.

5. Technical Failure. If deliverables fail to meet the technical specifications agreed upon in the project brief, and OrionMetricLabs is unable to resolve the issues within a reasonable timeframe (not exceeding 30 calendar days from notification), the client is entitled to a full refund for the affected milestone(s).

6. Non-Refundable Items. The following are non-refundable: (a) completed and accepted milestone deliverables; (b) third-party licensing fees or infrastructure costs already incurred on the client's behalf; (c) consulting or advisory sessions that have been delivered.

7. Refund Process. Refund requests must be submitted in writing to [email protected] with a description of the grounds for the refund. OrionMetricLabs will acknowledge receipt within 3 business days and process approved refunds within 14 business days via the original payment method.

8. Dispute Resolution. In the event of a refund dispute, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedies. This policy is governed by Spanish consumer protection legislation.

Terms of Service

1. Acceptance. By engaging the services of OrionMetricLabs, located at Calle Volver a Empezar 8 E, Planta Baja B, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree, do not proceed with any service engagement.

2. Scope of Services. OrionMetricLabs provides custom API-first web application development, third-party software integration, cloud infrastructure deployment, and related technical services. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a written project agreement or statement of work (SOW) mutually agreed upon before work commences.

3. Client Obligations. The client shall: (a) provide accurate and complete project requirements at the outset; (b) supply necessary API keys, credentials, and access permissions in a timely manner; (c) designate a single point of contact for project communications; (d) review and provide feedback on deliverables within agreed review windows (default: 5 business days per review cycle).

4. Intellectual Property. Upon full payment, all custom code, configurations, and documentation created specifically for the client under a project agreement become the client's intellectual property. Pre-existing frameworks, libraries, tools, and general-purpose code used by OrionMetricLabs remain the property of OrionMetricLabs and are licensed to the client for perpetual use within the scope of the delivered project.

5. Confidentiality. Both parties agree to maintain the confidentiality of proprietary information exchanged during the engagement. This includes API credentials, business logic, architectural patterns, and client data. This obligation survives termination of the engagement for a period of 3 years.

6. Payment Terms. Invoices are issued according to the milestone schedule defined in the project agreement. Payment is due within 14 calendar days of invoice date. Late payments incur a statutory interest rate per Spanish civil code Article 1108. OrionMetricLabs reserves the right to suspend work if payment is overdue by more than 21 days.

7. Limitation of Liability. OrionMetricLabs shall not be liable for indirect damages, lost profits, data loss, or business interruption arising from service delivery. Total liability under any engagement is capped at the total fees paid by the client for the specific project giving rise to the claim.

8. Warranty. OrionMetricLabs warrants that all deliverables will conform to the specifications defined in the project agreement for a period of 90 days following final delivery. This warranty covers defects in workmanship and does not cover issues arising from third-party software changes, client modifications, or environmental factors beyond our control.

9. Termination. Either party may terminate a project agreement with 14 days' written notice. Upon termination, the client pays for all completed milestones and any documented in-progress work up to the termination date. OrionMetricLabs will deliver all work product completed to date within 7 business days of termination.

10. Governing Law. These Terms are governed by the laws of the Kingdom of Spain. Any disputes shall be resolved before the competent courts of Madrid, Spain.
